These terms are placeholder language and will be replaced with attorney-drafted terms before the platform accepts any paying customers. The final Terms of Service will include, at minimum: limitation of liability, data accuracy disclaimers, permitted use restrictions, indemnification, mandatory arbitration, and prohibited FCRA-regulated uses.

1. Service Description

DaaS Whats Up provides carrier risk assessment data derived from publicly available government records. The service is provided for business due diligence purposes only.

2. Data Accuracy

All data is sourced from public government databases and processed through our transformation pipeline. While we strive for accuracy, we do not independently verify the accuracy of government source data. Risk assessments, performance rankings, and identity pattern signals are generated through automated analysis and are advisory in nature.

3. Permitted Use

You may use DaaS Whats Up for business carrier vetting and risk assessment purposes. You may NOT use this service as the sole basis for carrier selection decisions, for any purpose regulated under the Fair Credit Reporting Act (FCRA), or to harass, discriminate against, or defame any motor carrier or individual.

4. Limitation of Liability

Our aggregate liability to you for all claims arising from your use of the service shall not exceed the total fees paid by you in the twelve (12) months preceding the claim. The service is provided “AS IS” and “AS AVAILABLE” without warranty of any kind.

5. Carrier Data Disputes

If you are a motor carrier and believe any data displayed about your company is inaccurate, please note that our data is sourced from FMCSA and other government databases. To correct source data, please submit a request through FMCSA DataQs. If you believe our analysis of official data contains an error, contact us at the email below.
